The importance of Brand Protection

In addition, registering a trademark provides you with a legally enforceable right to stop other traders from using your Trademark to advertise similar goods or services without authorisation. Trademark infringement occurs when someone attempts to use a registered trademark to sell similar products or services without permission. Under such circumstances, you can use a simple cease and desist letter to stop the infringement from continuing. If the letter fails to stop the violation, you can enforce other methods.

 

 

A registered trademark protects your brand’s greatest assets and stops the competitors from ruining its reputation. The “TM” symbol should be used for any intellectual property that fits one of two categories:

  • The ™ is not proof of ownership, but it lets people know that you are claiming the rights of the trademarked symbol or words. To ensure proof of ownership, you must prove that you were the first to use the Trademark and that if anyone else tries to use it, it can cause material harm to you.

The Registered® can use once your application for a trademark has approval officially. The ® symbol is proof that you have registered your Trademark. It gives them the freedom to use the Trademark in any way they desire without fear of getting copied by others and seeking damages against its unauthorised infringement. It also prevents others from selling similar products or services under your brand name. In other words, listing your symbol or words as Registered® establishes you as the owner of a Trademark and protects you against the damage posed by the unauthorised infringement.
